These Terms govern your use of the Lifestyle Therapy & Coaching website and coaching services, operated by JC Enterprise Group, Inc., 5416 Alumni Drive NW, Huntsville, AL 35806 ("we," "us"). By using our site or coaching services you agree to these Terms and our Privacy Policy. Licensed therapy is provided under a separate clinical agreement and informed consent.
Our coaching services and website content are for informational and educational purposes and are not medical or mental-health treatment, diagnosis, or a substitute for professional care. No provider–patient relationship is created by coaching or by using this website. If you are in crisis or thinking about harming yourself or someone else, call or text 988 or call 911 and seek qualified professional help. Where you receive licensed therapy from our clinicians, that clinical relationship is governed by your separate clinical agreement, informed consent, and HIPAA Notice of Privacy Practices.
Coaching services and purchases are intended for adults 18 and older. (Clinical services for minors are arranged through the clinical intake with guardian involvement.)
Sessions, programs, and products are billed as stated at purchase. Recurring plans renew automatically unless cancelled before the next billing date. Cancellation, rescheduling, and refund terms are those presented at booking/purchase.
Your use of our services must comply with United States federal law and the law of your state and local jurisdiction. Any illegal use will result in removal of the content and may result in deactivation of your account. No unlawful, harmful, harassing, or infringing activity; no attempts to breach security or scrape the site. Don't submit others' personal or health information without authorization.
You keep ownership of what you submit and grant us a limited license to use it to provide services. Our content, programs, and materials are owned by us or our licensors; you receive a personal, revocable license.
The website and coaching are provided "as is," without warranties, and we do not warrant any particular outcome. To the fullest extent permitted by law, JC Enterprise Group, Inc. is not liable for indirect, incidental, consequential, or punitive damages; total liability will not exceed the greater of amounts you paid us in the prior 12 months or US $100. (These limitations do not alter any rights or obligations that apply to licensed clinical care under law.)
We may suspend or terminate access for violations. Governed by the laws of the State of Alabama. We may update these Terms (revising the "Last updated" date).
These Terms are governed by the laws of the State of Alabama, without regard to its conflict-of-law rules.
Any dispute arising out of or relating to these Terms or the service shall be resolved by binding arbitration seated in Huntsville, Madison County, Alabama, under the rules of the American Arbitration Association. You waive the right to bring or participate in any class, collective, or representative action.
Any matter not subject to arbitration — including an action to compel arbitration, to enforce an award, or to seek injunctive relief — shall be brought exclusively in the state or federal courts located in Madison County, Alabama, and you consent to the personal jurisdiction and venue of those courts.
Subscriptions and purchases. A full refund is available within 7 days of your first payment. After 7 days, a subscription is refundable on a pro-rated basis only where the service was unavailable for a sustained period attributable to us; a change of mind after 7 days is not a qualifying ground.
Rescheduling. A scheduled session may be rescheduled without charge with at least 24 hours' notice. With less than 24 hours' notice, or where the session is missed without notice, the session is treated as delivered and is not refundable.
You may stop using our services and close your account at any time.
We may suspend or terminate your access at our sole discretion, for any reason, including but not limited to: (a) a material breach of these Terms; (b) non-payment; (c) violation of our policies, including the acceptable use section above; (d) conduct that places another user, our staff, or the service at risk; or (e) a requirement of law.
Where practicable and not prohibited, we will give notice. Termination does not entitle you to a refund except as set out above, and does not relieve you of amounts already due.
This document is versioned. Minor corrections increment the decimal (for example 2.0 to 2.1); a material revision increments the whole number (2.0 to 3.0). The version in effect at the time an incident, claim, or dispute arises is the version that governs that matter, regardless of any later revision. Prior versions and their effective dates are retained and available on request.
